Terms of Service

1. Terms

By accessing our apps, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing Kidplay Apps. The materials contained in Kidplay Apps are protected by applicable copyright and trademark law.

2. Medical Disclaimer (Fever Whiz)

Fever Whiz is not a medical device, and it does not provide medical advice. Fever Whiz is a logging and reminder tool that helps parents and caregivers record medications, doses, temperatures, and symptoms for a child, and that displays a countdown to the next suggested dose window.

  1. Any dose amounts, intervals, or other information shown in Fever Whiz are general suggestions based on commonly published pediatric dosing tables. They are not medical advice, are not tailored to your child, and we do not warrant their accuracy, completeness, or suitability for any particular child.
  2. Nothing in Fever Whiz is a substitute for the advice of a qualified healthcare professional. Always confirm medications, dosages, and intervals with your child's pediatrician, pharmacist, or other healthcare provider before acting.
  3. Fever Whiz does not diagnose conditions, recommend treatments, or determine whether a dose is safe. You are solely responsible for any decisions you make about your child's care.
  4. In a medical emergency, call your local emergency services or contact a healthcare professional immediately. Do not rely on Fever Whiz.
  5. You are responsible for the accuracy of the information you enter and for keeping it up to date. Reminders and notifications may be delayed or not delivered due to device, network, or operating-system conditions, and you should not rely on them as your sole means of administering or tracking medication.

3. Use License

  1. Permission is granted to download and install Kidplay Apps on devices you own or control, and to use them for your personal, non-commercial purposes, subject to these terms and any applicable app store terms. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify, copy, or create derivative works of the apps or their content except as expressly permitted by these terms;
    2. use the apps for any commercial purpose;
    3. attempt to decompile or reverse engineer any software contained in Kidplay Apps, except to the extent that applicable law expressly permits;
    4. remove any copyright or other proprietary notations from the apps or their content; or
    5. redistribute, sublicense, sell, rent, lease, or otherwise transfer the apps to another person, or make them available on a network or server for use by others.
  2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Kidplay Technologies LLC at any time. Upon termination of this license, you must stop using and delete any copies of the apps in your possession.

4. Your data and content

  1. You retain ownership of the information and content you enter into our apps, including information you record about a child. You grant Kidplay Technologies LLC a limited license to host, store, process, transmit, and back up that information solely to operate the apps and provide their features, including synchronizing your data across your devices and sharing it with caregivers you invite. Our handling of your information is described in our Privacy Policy.
  2. You are responsible for the accuracy of the information you enter and for having the right to provide any information about another person, including a child.

5. Subscriptions and payments

  1. Some features of our apps are offered as paid one-time purchases or as auto-renewing subscriptions. Current pricing and the features included are shown in the app at the time of purchase.
  2. Purchases and subscriptions are processed by the applicable app store (such as the Apple App Store or Google Play), not directly by Kidplay Technologies LLC. The app store's terms govern your payment, and your purchase is subject to those terms.
  3. Auto-renewing subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price then in effect for your region.
  4. You can manage or cancel a subscription, and turn off auto-renewal, in your app store account settings. Deleting the app does not cancel a subscription.
  5. Except where required by law, payments are non-refundable, and refunds are handled by the applicable app store under its policies. We do not control app store refund decisions.
  6. Pricing, included features, and the availability of purchases may change over time. Changes do not affect a one-time purchase already completed, and changes to a subscription price will be handled in accordance with the applicable app store's requirements.

6. Disclaimer

  1. The materials within Kidplay Apps are provided on an 'as is' basis. Kidplay Technologies LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
  2. Further, Kidplay Technologies LLC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to Kidplay Apps.

7. Limitations

In no event shall Kidplay Technologies LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Kidplay Apps, even if Kidplay Technologies LLC or a Kidplay Technologies LLC authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

8. Accuracy of materials

The materials appearing in Kidplay Apps could include technical, typographical, or photographic errors. Kidplay Technologies LLC does not warrant that any of the materials on Kidplay Apps are accurate, complete or current. Kidplay Technologies LLC may make changes to the materials contained in Kidplay Apps at any time without notice. However Kidplay Technologies LLC does not make any commitment to update the materials.

9. Links

Kidplay Technologies LLC has not reviewed all of the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Kidplay Technologies LLC of the site. Use of any such linked website is at the user's own risk.

10. Modifications

Kidplay Technologies LLC may revise these terms of service for its app at any time without notice. By using Kidplay Apps you are agreeing to be bound by the then current version of these terms of service.

11. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of Georgia, United States, and you irrevocably submit to the exclusive jurisdiction of the courts located in that State.
